1. Agreement to These Terms
These SMS Terms and Conditions ("SMS Terms") govern text messages sent by or on behalf of Plan B Productions ("Plan B Productions," "we," "our," or "us").
By providing your mobile telephone number and affirmatively agreeing to receive text messages through a form, registration, ticket request, promotion, or other opt-in process, you agree to these SMS Terms, our Privacy Policy, and our Terms of Use.
The consent language shown at the time you provide your number is part of these SMS Terms. If event-specific or promotion- specific SMS terms are presented, those additional terms also apply.
2. Program Description
The Plan B Productions messaging program may include communications relating to the Halloween at the Fair and other current or future Plan B Productions events, productions, promotions, ticket offers, registrations, and services.
Messages may be sent using automated technology or through a third-party messaging provider, including Twilio or a comparable service provider.
Participation in the messaging program is voluntary. The particular form, ticket offer, registration, or promotion through which you enroll may describe the messages associated with that enrollment.
3. Consent to Receive Messages
You consent to receive text messages at the mobile number you provide when you take an affirmative action indicating agreement, such as selecting a consent checkbox and submitting the applicable form.
Your consent applies to messages described in the disclosure presented at the time of enrollment, which may include messages about your complimentary or paid tickets, the Halloween at the Fair, future Plan B Productions events, promotions, and special offers.
You represent that you are the subscriber or customary user of the mobile number provided, or that you are otherwise authorized to consent to messages at that number.
Consent remains effective until you revoke it. You may revoke consent at any time using the opt-out instructions below.
4. Types of Messages
Depending on how you enrolled and how you interact with us, messages may include:
- Halloween at the Fair ticket and registration notifications
- Registration confirmations
- Ticket-delivery or redemption instructions
- Event reminders
- Schedule, venue, entrance, and parking information
- Weather, safety, cancellation, or postponement updates
- Customer-service communications
- Upcoming event announcements
- Future event and ticket announcements where covered by your consent
- Promotional offers and special offers
- Surveys and attendee feedback requests
- Information about other Plan B Productions events and services
Not every participant will receive every type of message.
5. Message Frequency
Message frequency varies based on the events, registrations, promotions, and communications associated with your mobile number.
Messaging may be more frequent immediately before an event or when an important operational update is necessary. We do not guarantee a specific number of messages per day, week, or month.
6. Message and Data Charges
Standard message and data rates may apply according to your agreement with your wireless carrier. Plan B Productions does not charge a separate fee merely for participating in the SMS program.
You are responsible for charges imposed by your wireless carrier, including charges related to text messages, data use, roaming, or other mobile services.
7. How to Opt Out or Revoke Consent
The easiest way to stop SMS messages is to reply STOP to a message from us.
STOP is not intended to be the exclusive method for revoking consent where applicable law recognizes other reasonable methods. You may also communicate a clear revocation request in another reasonable reply to a message, or email tickets@halloweenatthefair.com with the mobile number involved and a clear request to stop text messages.
We will honor valid revocation requests within the time required by applicable law and, where the FCC's TCPA rules apply, within a reasonable time not exceeding ten business days after receipt. We may process requests sooner.
After a valid opt-out or revocation request, you may receive one non-promotional confirmation text acknowledging the request. We will not use that confirmation to market to you.
After opting out, you should no longer receive SMS messages that require the consent you revoked unless you later provide new valid consent. Ticket, registration, or event information may still be provided through email, the website, or another lawful non-SMS method.
Opting out of SMS does not automatically unsubscribe you from email communications. Email preferences must be managed separately.

Include the mobile number involved and a brief description of the issue. Do not send sensitive financial, identification, password, or payment-card information by text or email.
Our current custom messaging workflow is not operated as a general two-way customer-service inbox. We therefore do not promise that texting HELP or another support keyword will produce an automated or monitored support response. Use the email address above for assistance.
9. Your Mobile Number and Account Responsibility
You are responsible for providing a valid mobile number and keeping your contact information current.
If you change, transfer, deactivate, or relinquish your mobile number, you should opt out before doing so and notify us when reasonably necessary. This helps prevent messages intended for you from being sent to a later user of the number.
You are responsible for maintaining the security of the mobile device and account through which messages are received.
10. Delivery, Carriers, and Availability
Message delivery is subject to wireless carrier networks, device compatibility, Internet and cellular availability, service provider systems, and other circumstances outside our control.
Wireless carriers are not liable for delayed or undelivered messages. Plan B Productions does not guarantee that every message will be delivered, delivered immediately, or displayed correctly.
The messaging program may not be available through every carrier, device, number type, or geographic area.
11. Privacy and Use of Information
We collect and use mobile numbers, registration information, enrollment and consent records, messaging history, delivery information, opt-out and suppression information, and related technical data as described in our Privacy Policy.
For Halloween at the Fair, registration and communication records may be retained to administer tickets, provide event information, document consent and opt-outs, prevent duplicate or unwanted messaging, analyze the effectiveness of our communications, and, where permitted by your consent and applicable law, communicate about future geographically relevant Plan B Productions events, promotions, and special offers.
Information may be processed by service providers reasonably necessary to operate the program, including Twilio for SMS delivery and opt-out handling, website and database hosting providers, email providers, ticket or validation services, and professional service providers.
We do not sell your mobile number for money and do not provide our SMS subscriber list to unrelated third parties for their own independent direct-marketing programs. Additional information about advertising, audience matching, data sharing, retention, and privacy rights is provided in our Privacy Policy.
12. Eligibility and Minors
Halloween at the Fair is a family event for guests of all ages; however, the online ticket registration and associated SMS enrollment must be completed by an adult age 18 or older.
Children and other minors may be included in an adult registrant's requested ticket quantity. We do not ask minors to provide their own mobile numbers or enroll themselves in the promotional SMS program.
If we learn that a minor was enrolled contrary to these requirements, we may remove the mobile number from the messaging program and take reasonable steps consistent with our Privacy Policy.
13. Prohibited Use
You may not use the messaging program to:
- Harass, threaten, defraud, or impersonate another person
- Transmit unlawful, abusive, or malicious content
- Interfere with messaging systems or security controls
- Enroll a number you are not authorized to use
- Submit automated, fraudulent, or duplicate registrations in violation of an offer
- Violate applicable law or another person's rights
We may suspend or terminate participation when reasonably necessary to protect the program, our users, our service providers, or our legal rights.
14. Changes to or Termination of the Program
We may modify, suspend, replace, or discontinue all or part of the messaging program at any time, including its content, sending number, technology, service provider, or message frequency.
We may revise these SMS Terms to reflect changes in the program, our events, technologies, providers, practices, or legal obligations. When we update these SMS Terms, we will revise the “Last Updated” date at the top of this page.
Material changes will apply prospectively as required by applicable law. Continuing to participate after an effective update constitutes acceptance only to the extent permitted by law.
15. Disclaimers
To the fullest extent permitted by law, the messaging program is provided on an “as is” and “as available” basis without warranties of uninterrupted availability, immediate delivery, error-free operation, or compatibility with every carrier or device.
Text messages are a supplemental communication method. You remain responsible for reviewing your ticket, registration, event listing, email confirmation, and official event website for applicable information.
Nothing in these SMS Terms excludes a warranty, right, or consumer protection that cannot lawfully be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, Plan B Productions and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from delayed, failed, misdirected, incomplete, or unavailable text messages or from participation in the messaging program.
These limitations do not apply to liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, or other conduct for which limitation is prohibited by applicable law.
17. Governing Law
These SMS Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply.
The dispute, severability, waiver, and other general provisions in our Terms of Use also apply to the messaging program to the extent they do not conflict with these SMS Terms or applicable law.
