1. Agreement to These Terms

These Terms of Use ("Terms") form an agreement between you and Plan B Productions ("Plan B Productions," "we," "our," or "us") concerning your use of the Halloween at the Fair website, online ticket-registration system, digital services, and related event services.

By accessing the website, submitting a registration, requesting tickets, using a ticket or registration code, or otherwise using our digital services, you acknowledge that you have reviewed and agree to these Terms.

These Terms incorporate our Privacy Policy and, where you enroll in SMS communications, our SMS Terms and Conditions.

If you do not agree to these Terms, do not use the website or registration system.

2. Eligibility and Adult Registration

The Halloween at the Fair online registration system must be completed by an adult age 18 or older. The event itself is intended for families and guests of all ages.

By submitting a registration, you represent that you are at least 18 years old and that the information you provide is accurate and belongs to you or is information you are authorized to provide.

Children and other guests may be included in an adult registrant's requested ticket quantity. Minors should not submit the registration form using their own personal contact information.

The registration form may use a date-of-birth entry solely to verify adult eligibility. As described in our Privacy Policy, the date entered for this verification is not retained in the Halloween registration database.

3. Free Tickets and Registration

Halloween at the Fair admission tickets distributed through our current registration offer are provided without an admission charge. "Free tickets" refers to event admission only and does not mean that every product, service, attraction, parking option, food item, ride, game, vendor offering, or activity at or associated with the event is free.

Registration may be required to receive or use free admission tickets. We may establish reasonable ticket limits, registration limits, redemption procedures, entry procedures, or anti-abuse controls.

A registration, ticket, QR code, confirmation number, or other admission credential is a limited, revocable license to enter the applicable event, subject to these Terms, posted event rules, venue rules, capacity restrictions, safety requirements, and applicable law. It does not convey any ownership interest.

Tickets and registrations may not be duplicated, altered, counterfeited, fraudulently generated, or used in a manner that circumvents stated ticket limits or registration controls.

We may reject, cancel, invalidate, or limit registrations or admission credentials that we reasonably believe are fraudulent, duplicated, automated, abusive, obtained in violation of these Terms, or otherwise inconsistent with the applicable offer.

4. Parking and Other Charges

Free event admission does not include parking. Parking fees, if any, are separate from event admission and may be collected at the venue, online, or through another authorized parking provider.

Other optional products or services may also require payment, including food, beverages, carnival rides or games, merchandise, vendor purchases, premium experiences, or other separately offered activities.

Prices, payment methods, refund terms, and other conditions applicable to separately purchased products or services may be provided at the point of sale or by the applicable third-party provider.

5. Event Dates, Attractions, Schedules, and Changes

Published event dates, hours, attractions, entertainment, fireworks, rides, games, vendors, food offerings, performers, activities, layouts, and schedules are subject to change.

Attractions may be added, removed, delayed, relocated, modified, suspended, or unavailable for operational, safety, weather, staffing, vendor, regulatory, technical, capacity, or other reasons.

Promotional images, illustrations, renderings, advertisements, and descriptions are intended to communicate the nature or theme of the event and do not guarantee that every depicted or described element will be present in exactly the manner shown.

6. Admission and Event Rules

Admission is subject to venue capacity, operating hours, safety requirements, applicable laws, posted rules, and instructions from authorized event or venue personnel.

We and the venue may deny entry or remove a person when reasonably necessary for safety, security, compliance with law, violation of event or venue rules, disruptive conduct, harassment, threats, violence, intoxication, fraud, damage to property, or interference with event operations.

Guests are responsible for reviewing and following posted signage, restricted-area rules, attraction requirements, safety instructions, and lawful directions of staff.

Prohibited items, bag restrictions, security screening, re-entry procedures, animal policies, smoking rules, and other venue requirements may be established or updated by Plan B Productions or the San Joaquin County Fairgrounds.

7. Children and Family Attendance

Halloween at the Fair welcomes families and children, but parents, guardians, and accompanying adults remain responsible for the supervision, conduct, and safety of minors in their care.

Certain attractions, rides, activities, or experiences may have age, height, health, supervision, or other participation requirements. Guests must comply with the requirements posted for each applicable attraction or activity.

8. Safety and Assumption of Ordinary Event Risks

Attendance at a live public event involves ordinary risks, including crowds, uneven surfaces, weather, noise, lighting, moving equipment, rides or attractions, food and beverage service, interactions with other guests, and transportation or parking areas.

You are responsible for exercising reasonable care, following safety instructions, assessing whether an activity is appropriate for you or members of your group, and seeking assistance when needed.

Nothing in these Terms is intended to waive or limit rights or protections that cannot lawfully be waived or limited under applicable law.

9. Weather, Cancellation, Postponement, and Force Majeure

The event or individual attractions may be delayed, suspended, relocated, modified, postponed, shortened, or canceled because of weather, fire, smoke, emergency conditions, government or public-safety orders, utility interruptions, labor or vendor issues, transportation disruptions, acts of God, civil disturbances, equipment failures, or other circumstances beyond our reasonable control.

Because current Halloween at the Fair admission tickets are offered without an admission charge, cancellation or modification of the event does not create a right to a refund of an admission price that was not paid. Separate purchases, including parking or third-party products or services, are governed by the terms applicable to those purchases.

10. Email and SMS Communications

If you register for tickets or otherwise provide contact information, we may send transactional or operational communications reasonably related to your registration, tickets, attendance, schedule, venue, parking, weather, safety, cancellation, or other event administration.

Where you have provided the applicable consent, or where otherwise permitted by law, we may also send promotional communications concerning future Plan B Productions events, promotions, ticket opportunities, and special offers.

Promotional email messages are subject to applicable unsubscribe requirements. SMS communications are governed by our SMS Terms and Conditions, including information about message frequency, message and data rates, consent, and opt-out rights.

You are responsible for providing accurate contact information and for maintaining access to the email address and mobile number you submit.

11. Privacy and Data Use

Our collection, use, retention, disclosure, advertising use, and protection of personal information are described in our Privacy Policy.

Registration information may be used to administer the event, deliver and validate tickets, maintain consent and suppression records, prevent abuse, understand attendance and marketing performance, improve our services, and, where permitted, communicate about future Plan B Productions events and promotions.

Our Privacy Policy also explains how information may be processed by service providers, used with advertising and analytics platforms, retained, and subject to applicable privacy choices or rights.

12. Acceptable Use of the Website and Registration System

You may use the website and registration system only for lawful, personal, and legitimate purposes.

You may not:

• Submit false, fraudulent, misleading, or unauthorized information
• Impersonate another person or enroll a contact method you are not authorized to use
• Use bots, scripts, automated tools, or other methods to generate registrations or circumvent ticket limits
• Attempt to access accounts, databases, administrative areas, source code, credentials, or systems without authorization
• Interfere with website, hosting, database, messaging, ticketing, or security systems
• Upload or transmit malicious code, viruses, or harmful content
• Scrape or harvest personal information from the website or registration system
• Copy, alter, forge, resell, or misuse registration credentials or tickets
• Use the services in violation of law or the rights of another person

We may restrict or terminate access, invalidate registrations, preserve relevant records, and take other reasonable measures when we believe the website or registration system is being misused.

13. Intellectual Property

Unless otherwise indicated, the website and event-related materials, including names, logos, graphics, artwork, photographs, illustrations, text, layouts, promotional materials, and other content created or owned by Plan B Productions are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial purposes. You may not reproduce, distribute, modify, publish, sell, license, exploit, or create derivative commercial uses of protected materials without authorization from the applicable rights holder.

Third-party names, logos, artwork, products, and trademarks remain the property of their respective owners.

14. Third-Party Services, Vendors, and Links

The website, event, or communications may reference or link to third-party services, vendors, exhibitors, sponsors, payment processors, social-media platforms, parking services, attractions, or other businesses.

Unless expressly stated otherwise, third parties operate independently and may maintain their own terms, privacy policies, prices, refund policies, warranties, and practices. Plan B Productions does not control the independent acts, products, services, security, availability, or policies of unaffiliated third parties.

Your dealings with an independent vendor or third-party provider may create a separate agreement between you and that provider.

15. Photography, Video, and Event Media

Halloween at the Fair is a public event at which photography, video recording, livestreaming, news coverage, social-media content, and promotional content may occur.

Plan B Productions may photograph or record general event scenes, attractions, crowds, activities, and public areas for documentation, news, archival, advertising, social-media, and promotional purposes, subject to applicable law.

We do not intend this provision to override any right or protection that cannot lawfully be waived, including applicable rights concerning commercial use of a person's likeness. Guests with a specific concern may contact event staff when reasonably practicable.

16. Disclaimers

To the fullest extent permitted by law, the website, registration system, digital services, and event information are provided on an "as is" and "as available" basis.

We do not warrant that the website or registration system will be uninterrupted, error-free, continuously available, compatible with every device or browser, or free from all security vulnerabilities.

We do not guarantee that every registration confirmation, email, SMS message, ticket, QR code, or other communication will be delivered immediately or successfully. Guests remain responsible for reviewing available event information and presenting any required admission credential.

Nothing in these Terms excludes any warranty, duty, remedy, or consumer protection that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Plan B Productions and its owners, officers, employees, contractors, agents, affiliates, co-producers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the website, registration system, digital communications, or free admission credentials.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability where applicable law prohibits limitation for fraud, willful misconduct, gross negligence, personal injury, or other legally protected claims.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or costs resulting from your own unlawful misuse of the website or registration system, your fraud or intentional misconduct, your infringement of another person's rights, or your material violation of these Terms.

This section is not intended to require a consumer to indemnify Plan B Productions for Plan B Productions' own negligence, unlawful conduct, or other liability where such an obligation would be prohibited by law.

19. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply.

Subject to any consumer right or law requiring otherwise, disputes concerning these Terms, the website, or the registration system may be brought in a court of competent jurisdiction located in San Joaquin County, California.

These Terms do not require private arbitration and do not contain a class-action waiver.

20. General Provisions

Severability

If a provision of these Terms is found unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted, and the remaining provisions will remain in effect.

No Waiver

Failure to enforce a provision on one occasion does not constitute a waiver of that provision or the right to enforce it later.

Entire Agreement

These Terms, together with the Privacy Policy, SMS Terms and Conditions, event-specific disclosures, and any additional terms presented for a particular purchase or service, constitute the applicable agreement concerning the subject matter they address.

Electronic Records

You agree that electronic records, disclosures, confirmations, and communications may be used in connection with the website and registration system to the extent permitted by law.

21. Changes to These Terms

We may update these Terms to reflect changes in the event, website, registration system, technologies, service providers, business practices, or legal requirements.

When these Terms are updated, we will revise the "Last Updated" date shown at the top of the page. Material changes will apply prospectively as required by applicable law.

A change to these Terms does not by itself expand the scope of an email or SMS marketing consent where applicable law requires separate or additional consent.
